			<content:encoded><![CDATA[<p>This morning <a href="http://www.mobilemarketer.com" target="_blank">mobile marketer</a> broke the <a href="http://www.mobilemarketer.com/cms/news/legal-privacy/14234.html" target="_blank">news</a> of pending litigation against Papa John&#8217;s for spamming customers via SMS. Filed in the U.S. District Court in Seattle on Monday, the lawsuit alleges Papa John&#8217;s Pizza of violating state and federal law with text message blasts sent to customers through mass texting service OnTime4U. Plaintiffs say they sometimes received 15 or 16 text messages in a row, sometimes in the middle of the night, for a grand total of 500,000 unwanted texts.</p>
<p>This case is just another example of how important it is to pick a mobile marketing provider who plays by the rules and protects you from legal action. Papa John&#8217;s failed to protect themselves when they hired OnTime4U to send out messages for franchisees who were misled in believing their customers had given consent to receive text promotions. Papa John&#8217;s could face a $500-$1500 fine per text message.</p>
